Contaminated PropertyFederal and state statutes continue to impose strict liability for the cost of cleaning up contaminated properties on their past and present owners and operators. In light of the potential liability, property owners will often consider voluntarily cleaning up a site even in the absence of agency pressure. We represent clients before regulatory agencies in structuring such cleanups. This allows us to help define the scope of the investigations and remediation activities, and negotiate consent orders and other agreements that might be necessary to achieve our clients' goals. We have helped our clients evaluate and take full advantage of opportunities presented by innovative legislation and agency policy initiatives designed to encourage the remediation and reuse of brownfields sites. RemediationOur work with corporate clients on remediation issues includes all facets of environmental law. These projects range from bringing cost recovery actions and regulatory advice to negotiating a multi-site agreement for the investigation and cleanup of operating facilities for several utility clients. RedevelopmentThe firm played a pivotal role in assisting a client to navigate through the procedures of the Land Recycling and Environmental Remediation Standards Act (Act 2) to transform a large, former industrial facility located in the City of Philadelphia and Montgomery County into a public golf course, thereby providing open space and a new recreational resource. |
