Biography:

Michael Carter is an associate with Manko, Gold, Katcher & Fox, LLP, where he concentrates his practice in environmental litigation, representing clients in state and federal courts as well as administrative forums. He has represented clients ranging from Fortune 100 companies to small businesses and individuals in a variety of matters, including:

  • Defense of a specialty chemicals company in a CERCLA cost recovery action brought by the U.S. Environmental Protection Agency, resulting in the dismissal of the federal government’s claims with prejudice (United States v. Rohm and Haas, 2010 U.S. Dist. LEXIS 99585 (D.N.J. Sept. 22, 2010))
  • Defense and resolution of a CERCLA private cost recovery action against a specialty metals manufacturer, including work as part of the firm’s team of appellate counsel in the U.S. Court of Appeals for the Third Circuit that secured a decision vacating a $13 million verdict entered in favor of the plaintiffs by the trial court (Agere Systems, Inc. v. Advanced Environmental Technology Corp., 602 F.3d 204 (3d Cir. 2010)).
  • Defense of claims in a large North Jersey sediments case, including state court litigation under the New Jersey Spill Act
  • Defense of personal injury and medical monitoring claims arising from alleged exposure to airborne emissions from manufacturing processes
  • Defense and resolution of challenge to municipal landfill permit before the Pennsylvania Environmental Hearing Board
  • Challenging EPA rules in the D.C. Circuit Court of Appeals, including rules issued under the Clean Air Act, the Resource Conservation and Recovery Act, and the Occupational Safety and Health Act
  • Representing clients in administrative proceedings to obtain reductions and credits in storm water fees assessed by the Philadelphia Water Department

Prior to joining the firm, Michael clerked for Judge Dolores K. Sloviter in the Third Circuit Court of Appeals. In law school, Michael was an editor of the University of Pennsylvania Law Review. He was also awarded the George Schechtman Prize, for the highest first-year contracts grade, the John Maurer Prize, for the highest first-year criminal law grade, and was a member of the Order of the Coif.
