Biography:
Carol McCabe has extensive experience assisting clients in complex air matters. She has represented a wide range of industrial and commercial entities in addressing local, state, and federal air regulations. Carol advises clients on compliance counseling, auditing, permitting, reporting, and enforcement response, including the following:
- assisting clients in interpreting, applying, and complying with state and federal air regulatory requirements, including under the federal New Source Performance Standard ("NSPS") and National Emission Standards for Hazardous Air Pollutants ("NESHAP") rules;
- assisting in the preparation of air permit applications, including construction permits, operating permits, Title V, Prevention of Significant Deterioration ("PSD"), and New Source Review ("NSR") applications for a variety of facilities including in Pennsylvania and New Jersey;
- negotiating with state agencies with respect to permit language and conditions;
- pursuing and resolving permittee appeals of air permits issued by state agencies;
- auditing a variety of industrial and commercial facilities for compliance with air regulatory requirements;
- assisting clients with the preparation of periodic reports, such as Title V semiannual deviation reports and annual compliance certifications, and NSPS and NESHAP semiannual and annual reports;
- responding to Clean Air Act ("CAA") Section 114 information requests issued by the U.S. Environmental Protection Agency ("EPA");
- commenting on and appealing rulemaking packages promulgated by state agencies and EPA; and
- defending enforcement actions brought by state and federal agencies.

Carol has authored articles and lectured on air regulation for The Legal Intelligencer, the Pennsylvania Bar Institute's Environmental Law Forum, and other publications and organizations. She was listed in Pennsylvania Super Lawyers magazine as a "Rising Star" in the category of environmental law in 2005, 2006, 2007, 2008, and 2010. In 2009 and 2010, Carol was also listed a "Rising Star" in New Jersey Super Lawyers magazine. She is also listed in Chambers USA - America's Leading Lawyers for Business.
While attending law school, Carol served as a summer law clerk to Judge Juan Perez-Gimenez in the District Court of Puerto Rico.
Carol serves on the Boards of Directors of the Friends of Lemon Hill and the Pennsylvania Environmental Council. She also serves as Chairperson of the Haverford Township Environmental Advisory Committee.
